SMS Terms & Conditions

These SMS Terms & Conditions ("SMS Terms") govern the text messaging program operated by SiteBuilt.ai ("SiteBuilt," "we," "us," or "our") on behalf of local service businesses ("Clients") that use the SiteBuilt.ai platform. By opting in to receive SMS messages from a SiteBuilt.ai-powered business, you agree to these SMS Terms.

These SMS Terms supplement the SiteBuilt.ai Privacy Policy and Terms & Conditions of Service.

1. Program Description

Program Name: SiteBuilt.ai SMS Communications

Program Operator: SiteBuilt.ai, Austin, Texas

SiteBuilt.ai is a technology platform that provides AI-powered receptionist services, website hosting, and SMS automation to local service businesses (such as painters, plumbers, HVAC technicians, landscapers, and other home service providers). When you interact with a SiteBuilt.ai-powered business, you may receive automated text messages on behalf of that business.

2. Types of Messages

SiteBuilt.ai sends the following types of SMS messages on behalf of our Clients:

Transactional Messages (require prior express consent)

• Missed-call text-back: An automated response when you call a business and they are unable to answer, acknowledging your call and asking how they can help;
• Appointment confirmations: Confirming details of a scheduled appointment;
• Appointment reminders: Reminding you of an upcoming appointment;
• Service follow-ups: Post-service messages related to your completed appointment or service visit.

Marketing Messages (require prior express written consent)

• Review requests: Asking you to share feedback about your experience with the business;
• Promotional messages: Special offers, discounts, or service promotions from the business (if applicable);
• Re-engagement messages: Messages to reconnect if you have not interacted with the business recently.

Marketing messages are only sent when you have provided prior express written consent, as required by the Telephone Consumer Protection Act (TCPA) and applicable FCC rules.

3. Consent and Opt-In

3.1 How Consent Is Collected

You may provide consent to receive SMS messages from a SiteBuilt.ai-powered business in the following ways:

• Inbound call: When you call a business powered by SiteBuilt.ai, your call serves as an inquiry, and the business may respond with a transactional text message (such as a missed-call text-back or appointment confirmation). This constitutes prior express consent for transactional messages only.
• Web form opt-in: When you submit your phone number through a business's website contact form or booking form that includes clear SMS consent disclosure language adjacent to the phone number field.
• Written consent: When you explicitly agree to receive marketing messages by checking an unchecked consent box on a form that clearly discloses the messaging program, frequency, and opt-out instructions.

3.2 Consent Requirements

• Consent is collected separately for transactional and marketing messages;
• No pre-checked boxes are used to obtain consent;
• Consent disclosure language appears clearly and conspicuously at the point of opt-in;
• All consent records (timestamp, phone number, IP address, exact language shown, and version) are stored securely for a minimum of four (4) years.

3.3 First Message Disclosure

The first automated message you receive from a SiteBuilt.ai-powered business will include:

• The business name;
• A description of the message type;
• Opt-out instructions (Reply STOP to opt out);
• Help instructions (Reply HELP for help); and
• A data rates disclaimer (Msg & data rates may apply).

4. Message Frequency

Message frequency varies based on your interactions with the business. Typical messaging frequency depends on the type of messages you receive:

Appointment reminder	1–2 messages per appointment
Service follow-up	1 message per completed service
Review request	Up to 1 message per completed service
Promotional (if opted in)	Up to 4 messages per month

You will never receive more messages than the frequency disclosed at the time of opt-in. If message frequency changes, we will provide updated disclosure and an opportunity to re-consent or opt out.

You can stop receiving text messages at any time by replying with any of the following keywords:

STOP CANCEL END QUIT UNSUBSCRIBE

We also honor Spanish-language opt-out keywords:

PARAR CANCELAR ALTO

When you text any of these keywords:

• Your opt-out is processed immediately;
• You will receive one final confirmation message: "You have been unsubscribed and will no longer receive messages from [Business Name]. Reply START to re-subscribe."
• Your opt-out preference is logged permanently and checked before every outbound message;
• No further messages will be sent to your number unless you affirmatively re-consent by texting START.

7. How to Get Help

If you need assistance with our SMS program, you can:

• Reply HELP to any message to receive program information and support contact details;

When you text HELP, you will receive a message with the program name, a brief description, and instructions for opting out or contacting support.

8. Messaging Hours

All automated SMS messages are sent only during permissible hours:

• No earlier than 8:00 AM and no later than 8:00 PM in the recipient's local time zone.

This schedule complies with the strictest state requirements (including the Florida Telephone Solicitation Act) and exceeds federal TCPA minimums. We will not send automated messages outside of these hours regardless of the type of message.

9. Carrier Liability Disclaimer

Wireless carriers (including but not limited to AT&T, T-Mobile, Verizon, and their affiliates) are not liable for any delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and their network conditions. SiteBuilt.ai is not responsible for messages that are delayed, not delivered, or blocked by your carrier or device settings.

10. Supported Carriers

Our SMS program is compatible with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, U.S. Cellular, and most regional and prepaid carriers. T-Mobile is not liable for delayed or undelivered messages.

11. Privacy and Data Use

Information collected through our SMS program (including your phone number, message content, opt-in status, and opt-out preferences) is handled in accordance with our Privacy Policy. Key points:

• We do not sell your phone number or personal information to third parties for marketing or advertising purposes;
• Phone numbers and messaging data are shared only with our telephony provider (Telnyx) as necessary to deliver messages;
• SMS logs are retained for three (3) years, then anonymized;
• Consent records are retained for a minimum of four (4) years;
• Opt-out records are retained permanently; and
• You may request deletion of your personal information at any time by emailing privacy@sitebuilt.ai.

12. Two-Party Messaging Model

SiteBuilt.ai operates a platform messaging model with two distinct relationships:

SiteBuilt.ai ↔ Business Client

Our business Clients (the local service businesses using our platform) authorize SiteBuilt.ai to send text messages on their behalf. This is governed by our Terms & Conditions and our Client service agreement.

Business Client ↔ You (End Customer)

When you receive a text message from a SiteBuilt.ai-powered business, that business is the sender of record. SiteBuilt.ai acts as the technology platform facilitating delivery. The business is responsible for ensuring they have appropriate consent to contact you. If you have questions about why you received a message from a specific business, please contact that business directly or reach out to us for assistance.

13. Compliance

SiteBuilt.ai's SMS program is designed to comply with:

• The Telephone Consumer Protection Act (TCPA) and FCC implementing rules;
• The CAN-SPAM Act as applied to commercial SMS;
• CTIA Messaging Principles and Best Practices (including Short Code Monitoring Council guidelines);
• 10DLC registration requirements through The Campaign Registry (TCR);
• The Florida Telephone Solicitation Act (FTSA) contact hour and frequency restrictions;
• Texas SB 140 marketing SMS registration and bonding requirements;
• The California Consumer Privacy Act (CCPA/CPRA) data rights requirements; and
• All other applicable federal and state laws governing automated text messaging.

14. Changes to These SMS Terms

We may update these SMS Terms from time to time. Material changes will be communicated via text message or email to affected recipients, and the updated terms will be posted on this page with a revised effective date. Continued receipt of messages after a change constitutes acceptance of the updated terms. You may opt out at any time by replying STOP.
