IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING SITEBUILT.AI SERVICES. By subscribing to, accessing, or using any services provided by SiteBuilt.ai ("SiteBuilt," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our services.
These Terms constitute a legally binding agreement between you and SiteBuilt.ai. We reserve the right to modify these Terms at any time, with notice provided as described in Section 28.
"AI Receptionist" means the artificial intelligence-powered voice agent provided through our platform that answers telephone calls, responds to inquiries, books appointments, and performs related functions on behalf of the Client's business.
"Client" means the individual or business entity that subscribes to SiteBuilt.ai services.
"End User" or "Caller" means any person who contacts the Client's business via the dedicated phone number provisioned by SiteBuilt.ai or who interacts with the Client's SiteBuilt-hosted website.
"Services" means the AI receptionist, dedicated phone number, website hosting, SMS automation, calendar integration, and related technology services provided by SiteBuilt.ai under the applicable subscription tier.
"Subscription Tier" means the service level selected by the Client: Starter ($149/month), Pro ($199/month), or Premium ($249/month), each with features as described on sitebuilt.ai at the time of subscription.

The specific features available to each Client depend on the selected Subscription Tier. Tier descriptions and feature sets are subject to change; current tier details are always available at sitebuilt.ai.
The AI Receptionist is powered by artificial intelligence technology. It is not a human being. All calls answered by the AI Receptionist are handled by an automated system using voice synthesis and natural language processing.
The AI Receptionist will identify itself as an AI assistant at the beginning of every call. SiteBuilt.ai does not design, intend, or permit the AI Receptionist to impersonate a human being.
The AI Receptionist is designed to handle routine inquiries, provide general business information, and schedule appointments. It is not a substitute for professional advice of any kind. The AI Receptionist:
SiteBuilt.ai is not liable for any business decisions, commitments, or representations made by the AI Receptionist during calls. The Client is solely responsible for reviewing and approving all AI configurations, reviewing performance at least weekly, promptly notifying SiteBuilt.ai of errors, and ensuring provided information is accurate and lawful.
SiteBuilt.ai's AI Receptionist is designed for informational and scheduling purposes and does not make decisions with legal or similarly significant effects on consumers. To comply with the Colorado Artificial Intelligence Act (SB 24-205) and demonstrate reasonable care, SiteBuilt.ai discloses to all Callers that they are interacting with an AI system, provides Callers with the option to request a human representative, and monitors the AI for potential algorithmic discrimination.
The AI Receptionist may analyze caller sentiment as part of post-call summaries. This analysis is used solely to improve service quality and flag interactions requiring human follow-up. Sentiment analysis is not used for discriminatory purposes and is not shared with third parties.
All calls handled by the AI Receptionist may be recorded for quality assurance, service improvement, dispute resolution, and compliance purposes.
The AI Receptionist will provide a disclosure at the beginning of each call informing the Caller that (a) they are speaking with an AI assistant and (b) the call may be recorded. SiteBuilt.ai implements an all-party notification standard to comply with requirements in all-party ("two-party") consent jurisdictions.
SiteBuilt.ai does not collect, capture, store, or process voiceprints, voice templates, or any biometric identifiers or biometric information as defined under the Illinois Biometric Information Privacy Act (740 ILCS 14), the Texas Capture or Use of Biometric Identifier Act (Tex. Bus. & Com. Code § 503.001), or any similar state biometric privacy law.
SiteBuilt.ai does not use your caller data or call recordings to train generalized, public AI models. Your customers' conversations stay yours. We will never feed your business's call data into a shared model that benefits other companies. This commitment is unconditional and survives termination of these Terms.
Each Client receives a dedicated local phone number. Upon termination, the Client may request to port their phone number to another carrier within fourteen (14) days. If no port-out request is received within fourteen (14) days, the number will be released.
The AI Receptionist primarily handles inbound calls initiated by Callers. SiteBuilt.ai does not use the AI Receptionist for outbound telemarketing, cold calling, or unsolicited sales calls.
SiteBuilt.ai sends outbound SMS messages on behalf of the Client for appointment booking confirmations, reminders, follow-up messages after service completion, review requests (Premium tier), and re-engagement messages (Premium tier).
Prior Express Consent: By providing a phone number during a call and confirming an appointment or requesting follow-up, the Caller provides prior express consent to receive transactional SMS messages. SiteBuilt.ai does not send marketing SMS without prior express written consent as required by the TCPA and FCC rules.
Opt-Out: Every SMS message includes instructions for opting out. Reply STOP to immediately cease all future SMS. Opt-out requests are processed immediately and logged permanently.

All outbound SMS are sent only during permissible hours: no earlier than 8:00 AM and no later than 9:00 PM in the recipient's local time zone, consistent with TCPA guidelines and any stricter state requirements.
For full details on how we collect, use, and protect personal information, see our Privacy Policy. We do not sell, share, rent, or trade Caller or Client data to third parties for advertising or marketing purposes.
SiteBuilt.ai proactively extends privacy rights (Right to Know, Delete, Correct, Opt Out, Non-Discrimination) to all individuals regardless of state of residence. To exercise any right, contact privacy@sitebuilt.ai.
As a Client of SiteBuilt.ai, you agree to:
SiteBuilt.ai is a technology service provider. We are not a party to the relationship between the Client and the Client's customers or Callers. SiteBuilt.ai does not guarantee the quality of any services provided by the Client, is not responsible for disputes between the Client and its customers, and does not perform background checks or verify credentials of any Client.
SiteBuilt.ai integrates with and references third-party services. The following marks are property of their respective owners and are used solely for identification under nominative fair use: Retell AI, Telnyx, Google Calendar, Google, HubSpot, Stripe, IONOS, ElevenLabs, and Cloudflare. SiteBuilt.ai claims no ownership of, affiliation with, sponsorship by, or endorsement from any of these companies.
All IP rights in the SiteBuilt.ai platform remain the exclusive property of SiteBuilt.ai. The Client receives a limited, non-exclusive, non-transferable, revocable license to use the Services during the subscription period.
The Client retains ownership of content provided to SiteBuilt.ai. By providing such content, the Client grants SiteBuilt.ai a limited, non-exclusive license to use it solely for delivering the Services. This license terminates upon termination of the subscription.
All subscriptions are billed monthly. No setup fees, annual contracts, or early termination penalties. Cancel anytime; cancellation takes effect at the end of the current billing period. Pricing changes require at least thirty (30) days' written notice.
Subscription fees are generally non-refundable. If the Services experience a continuous, verified outage exceeding twenty-four (24) consecutive hours due to causes within SiteBuilt.ai's reasonable control, the Client will receive an automatic service credit equal to the pro-rata daily rate for each full day of outage. Service credits are the Client's sole and exclusive remedy for service outages.
You may not use the Services to: violate any applicable law; conduct or facilitate fraud; harass or threaten any person; send unsolicited marketing communications in violation of the TCPA or CAN-SPAM Act; collect personal information in violation of any privacy law; impersonate any person or entity; use the AI Receptionist to provide professional advice; or interfere with or reverse-engineer the Services. Violation may result in immediate suspension or termination without refund.
Websites created by SiteBuilt.ai are owned by SiteBuilt.ai in terms of underlying code, templates, and infrastructure. The Client owns their content. SiteBuilt.ai makes commercially reasonable efforts to follow WCAG 2.1 Level AA standards but does not warrant full compliance with WCAG, ADA, or Section 508.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SITEBUILT.AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
15.1 Client Indemnification: You agree to indemnify, defend, and hold harmless SiteBuilt.ai from and against any third-party claims arising out of your use of the Services in violation of these Terms, any content you provide, any dispute between you and your customers, any inaccurate information provided for the AI Receptionist, your failure to maintain required licenses or insurance, and any violation of consumer protection laws resulting from your configurations.
15.2 SiteBuilt.ai Indemnification: SiteBuilt.ai will indemnify and defend the Client from third-party claims alleging that the SiteBuilt.ai platform itself (excluding Client-provided content) infringes any valid United States patent, copyright, or trademark.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SITEBUILT.AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. SITEBUILT.AI'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CLIENT DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Exceptions: These limitations do not apply to either party's indemnification obligations, gross negligence or willful misconduct, breach of confidentiality obligations, or the Client's payment obligations.
Pro and Premium tier Clients receive bilingual AI Receptionist capabilities (English/Spanish). SiteBuilt.ai makes commercially reasonable efforts to ensure accuracy but does not guarantee perfect translation. These Terms are in English; in case of conflict with any translation, the English version prevails.
In the event of a security breach, SiteBuilt.ai will investigate and contain the breach promptly, notify affected Clients within seventy-two (72) hours, notify affected individuals as required by applicable state law, and take reasonable steps to prevent recurrence.
SiteBuilt.ai respects intellectual property rights and complies with the Digital Millennium Copyright Act. To submit a DMCA takedown notice, contact legal@sitebuilt.ai.
SiteBuilt.ai may disclose personal information in response to valid legal process. Our policy is to evaluate each request for legal validity, provide only the minimum data required, and notify the affected Client before disclosure unless prohibited by law.
Termination by Client: Cancel at any time in writing. Cancellation takes effect at end of current billing period.
Termination by SiteBuilt.ai: SiteBuilt.ai may suspend or terminate immediately for Terms violations, payment delinquency over fourteen (14) days, legal requirement, or material risk.
Effect of Termination: Access discontinued; phone number available for port-out per Section 5.1 (14-day window); website taken offline; thirty (30) days to request data export.

These Terms are governed by Texas law without regard to conflict-of-law provisions. Legal actions shall be filed in state or federal courts in Travis County, Texas.
24.1 Informal Resolution: Before formal action, both parties will attempt to resolve disputes informally by written notice with a thirty (30) day resolution period.
24.2 Binding Arbitration: Unresolved disputes go to binding arbitration under AAA Commercial Arbitration Rules in Austin, Texas.
24.3 Exceptions: Either party may seek injunctive relief. Disputes under $10,000 may use small claims court in Travis County.
24.4 CLASS ACTION WAIVER: YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
SiteBuilt.ai is not liable for failures or delays due to causes beyond reasonable control, including natural disasters, pandemics, government actions, Internet or telecom failures, power outages, cyberattacks, acts of terrorism, labor disputes, or third-party provider failures.
Beta Features are provided "AS IS" without warranty and may be modified, suspended, or discontinued at any time without notice. SiteBuilt.ai's liability for Beta Features is limited to zero dollars ($0).
By using the Services, you consent to receive communications electronically. All electronic agreements, notices, and disclosures satisfy legal writing requirements.
Material changes communicated via email at least thirty (30) days before taking effect. Continued use constitutes acceptance. Cancel before effective date if you disagree.
Severability: Invalid provisions modified to minimum necessary; remaining provisions unaffected.
Entire Agreement: These Terms + Privacy Policy + applicable order forms = entire agreement.
Assignment: Client may not assign without written consent. SiteBuilt.ai may assign in connection with merger, acquisition, or sale.
Waiver: Failure to enforce a provision is not a waiver.
Independent Contractors: No partnership, joint venture, employment, or agency relationship is created.
Entity Status: SiteBuilt.ai is currently operated as a sole proprietorship by Travis Reed, Austin, Texas. Upon formation of SiteBuilt.ai LLC or any successor entity, all rights and obligations under these Terms will be assigned to and assumed by that entity.

You further acknowledge that the AI Receptionist is an artificial intelligence system and not a human agent, that calls may be recorded, that SiteBuilt.ai does not collect biometric data from call recordings, and that SiteBuilt.ai is a technology service provider and not a party to the relationship between you and your customers.
